You will be able to send confidential messages and communicate with a doctor regarding your diagnosis and treatment. INGENES will keep these messages private and confidential and will provide reasonable measures and best efforts to prevent leakage, disclosure of information or situations whereas such information might be compromised.

Information We Collect Automatically Through Your Use of our Site

These vendors and service providers will have access to your personal information in order to provide these services, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the service.

If you are a Patient or Donor: The medical services regarding Assisted Human Reproduction techniques, such as IVF, egg donation, embryo transfer, split treatments, cryopreservation of eggs and embryos and semen, sperm donation, PGT or any medical assessment regarding any medical services rendered by the Clinics, including studies, laboratories, diagnosis and genetic information, is subject to this Privacy Policy and might be shared for service purposes. Therefore, might be used for delivering you information about discounts, sweepstakes, notices and news regrading to our services, invitation to perform a complementary service and marketing.

 

Additionally, INGENES will collect any sensitive information regarding health and medical history, lifestyle and other data necessary for the means set forth above. In addition to the sharing described elsewhere in this Policy, we will share personal information with companies, organizations or individuals outside of INGENES when we have your consent to do so.

Your Rights

You are entitled to know which data we have collected from you, its use and conditions of service therefrom (Right to Access). You have a right that allows you to require from us to rectify or amend such data, if applicable, whereas is not actual, is not accurate or is incomplete (Right to Amend); although we have the right to oppose to those amendments in the event such medical information is scientifically accurate and we might not change it because of statutory or legal obligation.

You are entitled to require form us the deletion of information if you suspect we are not using that information correctly (Right to Deletion). Notwithstanding the latter, we may oppose to that right in the proportion of the information we need to keep as a medical institution or for security and law enforcement purposes. Consequently, you are entitled to oppose to the treatment of your personal information for specific means (Right to Oppose), whereas we may oppose in contrast if such ends and means are relevant for the rendering of the medical services. These rights are known in Mexico as the “Derechos ARCO”.

For the exercise of those rights you can extend a written or electronic request in a clear and respectful manner, indicating the information you are referring therein, along with an ID in force, in office hours in the Clinic you are being attended or at the email: avisoprivacidadcdmx@ingenes.com. 

In the event that the information provided in your application is erroneous or insufficient, or the corresponding accreditation documents are not attached, we may request you, within 15 (fifteen) business days following receipt of the application, to provide the elements or documents necessary to process it. You will have 10 (ten) business days to meet the request, counted from the day after you received it. If you do not respond within that period, the corresponding request will be deemed not submitted.

INGENES will notify you of the decision made on your application within a maximum period of 15 (fifteen) business days from the date of submission of your complete application (such communication being made through the email that we have for you or the one you provide with your written) and, if your request is appropriate, it will be effective within 15 (fifteen) business days following the date on which the response is communicated (highlighting that, in the event of the right of access, simple copies of files containing your personal data).

Likewise, we inform you that your personal data may be transferred and processed within and outside the country, by persons other than INGENES. In this sense, your information may be shared with laboratories, clinics, research centers, intermediaries, national and international providers and other service providers in general, that have to do with the services that are the subject of this notice. It will always be clearly specified if a service is performed by third party companies. In the event that your personal data is transferred, you will be informed of the purposes for which it will be transferred, as well as the request for your consent for it, in accordance with the procedures established in the Law.

Except for the aforementioned, we promise not to transfer your personal information to third parties without your consent, except when it is necessary for the maintenance or fulfillment of a legal relationship, as well as in the cases provided for in the Law, and where appropriate, to make this transfer under the terms established by Law.

Regardless of the foregoing, you may limit the use and disclosure of your personal data, for this you may register in the Public Registry to Avoid Publicity, which is in charge of the Federal Consumer Protection Agency (PROFECO), in order that your personal data is not used to receive advertising or promotions from INGENES, the Clinics, or their services. For more information on this registry, you can consult the PROFECO Internet portal, or contact it directly.

Legal Proceedings.

Your personal information may be used and disclosed by our organization, our office staff and others outside of our office that are involved in your care and treatment for the purpose of providing health care services to you, to support the operation of the organization, and any other use required by law.

We will share personal information with third party companies, organizations or individuals outside of INGENES if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

  • Meet any applicable law, regulation, inquiry, legal process or enforceable governmental request, either administrative or judiciary.
  • Enforce applicable Terms of Use, including investigation of potential violations.
  • Detect, prevent, or otherwise address fraud, security or technical issues.
  • Protect against harm to the rights, property or safety of INGENES, the Clinics, business associates, our users, customers or the public as required or permitted by law.

You declare that you have read and agree with the terms and conditions of the Privacy Notice made available to you, knowing the purpose of the collection and processing of your personal data, as well as the procedure for exercising your ARCO Rights.

By providing information via the internet, email, telephone or in person, you consent to this Privacy Notice.

Transfer in the Event of Sale or Change of Control.

If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

How to control your email preferences? 

For EU-based members, we will only send you promotional and marketing emails if you have given us your consent. We make every effort to promptly process all unsubscribe requests. CALIFORNIA PRIVACY RIGHTS

Under California’s Consumer Privacy Act (“CCPA”), California residents are entitled to know which information INGENES is collecting from them. This Privacy Notice acts as a “collection notice” for the full effect to the exercise of the “Right to Know” as provided in CCPA, so please direct to the kind of information INGENES is collecting hereunder. Additionally, in any event you are entitled to be disclosed which information was collected and the treatment to such information for the Services described on this Privacy Policy.

If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2021 will receive information regarding 2020 sharing activities).

Under the CCPA, California consumers have the right to:

• Request that a business that collects a consumer's personal data disclose the categories and specific pieces of personal data that a business has collected about consumers.
• Request that a business delete any personal data about the consumer that a business has collected.

INGENES is aware of the rights to opt-out for sale and to delete personal information. Upon request, INGENES shall attend the requirement and may refuse to stop the sale or deletion of information if such information is necessary for the services provided on this website, is necessary to have such information under provision of Law or pertains to medical services. We will provide the requested information to you at your email address in response. Please be aware that not all information sharing is covered by the “CCPA” requirements and only information on covered sharing will be included in our response. CONSENT TO PROCESSING OF PERSONAL DATA IN MEXICO

This Site is intended for use only by residents of Mexico If you are a citizen of the European Economic Area (EEA) or other jurisdiction outside of Mexico, please note that in order to provide our Site, products and services to you, we may send and store your personal information (also commonly referred to as personal data) outside of the EEA, including to Mexico and even the United States.
